Terms of Use

1. Purpose

These general terms of use (hereinafter "Terms") govern access to and use of the SmartTravely mobile application (hereinafter "the Application"), published by Julien Lemaitre, independent publisher.

By using the Application, you accept these Terms in their entirety.

2. Description of the service

SmartTravely is a travel planning application that uses artificial intelligence to generate personalized itineraries. The service includes:

• AI-powered travel itinerary generation.
• Customization and modification of activities.
• Access to weather forecasts and opening hours.
• Travel document storage (upcoming feature).

3. Registration and account

• Using the Application requires creating an account (email/password or sign-in via Google / Apple).
• You are responsible for keeping your credentials confidential.
• You must be at least 13 years old to use the Application.
• You agree to provide accurate information during registration.

4. Tokens and in-app purchases

4.1 Token system

The Application uses a token system to access generation features:

• 1 token = 1 day of travel to plan.
• 0.5 token = 1 modification of an activity (replacement or addition).

4.2 Purchases

Tokens are available for purchase through the following packs:

Purchases are processed by Apple through the In-App Purchase system. Prices are shown in euros including tax and may vary depending on your country.

4.3 Refunds

Purchased tokens are not directly refundable through the Application. For any refund request, please contact Apple support in accordance with their refund policy.

4.4 Complimentary tokens

Welcome tokens may be offered upon registration. SmartTravely reserves the right to modify the number of complimentary tokens at any time.

5. Intellectual property

• The Application, its content, design, and source code are the property of Julien Lemaitre.
• Itineraries generated by the AI are provided to the user for personal use.
• Any reproduction, redistribution, or commercial exploitation of the Application is prohibited without written authorization.

6. Limitation of liability

6.1 AI-generated itineraries

Itineraries are automatically generated by artificial intelligence. Although we strive to provide reliable information (schedules, weather, points of interest), SmartTravely does not guarantee the accuracy, completeness, or timeliness of the information provided.

Users are advised to verify critical information (opening hours, availability, weather conditions) before traveling.

6.2 Service availability

SmartTravely strives to ensure service availability but does not guarantee uninterrupted access. Temporary interruptions may occur for maintenance or updates.

6.3 Third-party services

The Application relies on third-party services (Google, Apple, weather and geographic data providers). SmartTravely is not responsible for interruptions or malfunctions of these services.

7. User conduct

The user agrees to:

• Use the Application in accordance with its intended purpose.
• Not attempt to circumvent security mechanisms or the token system.
• Not use the Application for unlawful or fraudulent purposes.
• Not overload the servers with automated or abusive requests.

Failure to comply with these rules may result in account suspension or deletion without notice.

8. Personal data

The processing of personal data is described in our Privacy Policy.

9. Modification of the Terms

SmartTravely reserves the right to modify these Terms at any time. Modifications take effect upon publication in the Application or on the website. Continued use of the Application after modification constitutes acceptance of the new Terms.

10. Termination

• The user may delete their account at any time from the Application or by contacting support.
• SmartTravely may suspend or delete an account in case of violation of these Terms.
• Unused tokens are not refundable in case of termination.

11. Applicable law

These Terms are governed by French law. In case of dispute, French courts shall have sole jurisdiction.
